Hydrographic Survey App — Terms of Use

These Terms of Use (“Terms”) govern your use of the Hydrographic Survey App (“the App”). By downloading or using the App, you agree to these Terms. If you do not agree, you must not use the App.

1. Purpose of the App

The App is a professional tool designed for hydrographers, surveyors, and students learning surveying techniques. It provides features for recording, managing, and exporting survey‑related information.

The App is not intended for general consumer use or for children.

2. Subscription and Access

The App requires an active subscription to access full functionality.

• A 7‑day free trial may be offered before billing begins.

• The free trial automatically converts to a paid subscription at the end of the trial period unless cancelled before the trial expires.

• Subscriptions are managed securely through Google Play and Apple App Store.

• You are responsible for managing, modifying, or cancelling your subscription through your platform’s account settings.

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

• No refunds are provided by the developer; all billing matters are handled by Google or Apple.

• To cancel: on iPhone go to Settings → [Your Name] → Subscriptions. On Android go to Google Play → Subscriptions.

If your subscription expires or is cancelled, access to premium features will be restricted.

3. User Data and Privacy

Your privacy is important. The App:

• stores all survey data locally on your device

• does not upload your survey data to any server

• only shares data when you choose to export it

• does not require an account or login

Subscription status is managed through RevenueCat, which collects:

• purchase history

• an anonymous app instance identifier

4. Acceptable Use

You agree not to:

• use the App for unlawful or harmful purposes

• attempt to reverse engineer, decompile, or modify the App

• interfere with the App’s functionality or security

• use the App in a way that could damage or impair its operation

You are responsible for ensuring the accuracy of any data you enter into the App.

5. Intellectual Property

All content, features, and design elements of the App are owned by the developer.

You are granted a limited, non‑exclusive, non‑transferable license to use the App for personal or professional surveying work.

You may not copy, distribute, or resell the App.

6. No Warranty

The App is provided “as is” without warranties of any kind.

The developer does not guarantee:

• accuracy of calculations

• suitability for any specific project

• uninterrupted or error‑free operation

You use the App at your own risk.

7. Limitation of Liability

To the maximum extent permitted by law:

• the developer is not liable for any loss, damage, or data errors resulting from your use of the App

• the developer is not responsible for decisions or outcomes based on survey data entered into the App

Your device, backups, and exported files remain your responsibility.

8. Changes to These Terms

The developer may update these Terms from time to time.

Continued use of the App after changes are published constitutes acceptance of the updated Terms.

9. Governing Law

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of Queensland, Australia, without regard to conflict‑of‑law principles. You agree to submit to the exclusive jurisdiction of the courts located in Queensland, Australia for the resolution of any such disputes.
